In this exciting interview, he discusses his work in the case of Cavanaugh, et al. v. Dwamena, et al, in which the late Patrick Cavanaugh went to Michiagn’s Sparrow Hospital with flu-like symptoms on July 20, 2003. He had experienced a persistent fever for 10 days prior. After an evaluation by physicians from the Michigan State University Health Team, he was admitted. Ultimately, Cavanaugh was suffering from a fungal infection known as histoplasmosis; however, it was not timely diagnosed by the internal medicine and infectious disease physicians managing his care. Nevertheless, Cavanaugh was not treated with any antibiotic, antifungal or antiviral medications during the first nine days of his admission. And, by the time he received any medicine, his systems had begun to fail and it was too late to save him. For the past 23 years, Matt has been tremendously successful in handling complex personal injury and medical malpractice cases. He was the recipient of the Hypertrophic Cardiomyopathy Association Award, which was based upon his successful representation of three families who filed federal tort claims against the National Institute of Health. He represents clients in multiple counties throughout the State of Michigan, and has litigated cases in states throughout the country including Indiana, Ohio, Illinois, Minnesota, Georgia, and Maryland. He specializes in birth trauma litigation, delay in diagnosing medical conditions, and wrongful death/catastrophic injury cases. He has successfully resolved hundreds of medical negligence cases and has been responsible for numerous settlements in excess of $1,000,000.
Gerald B. O’Connor has been specializing in the area of personal injury litigation - with a specific and significant emphasis in the representation of plaintiffs in medical malpractice claims - since 1972. In this powerful interview, he discusses his work in the case of Tineo v. St. Joseph’s Regional Medical Center, involving a young boy named Justin Tineo who was born with myotubular myopathy (MTM), a hereditary muscle-wasting disease. His mother, Wanda Tineo, was a carrier, and two of her nephews died of the disease shortly after birth. Mrs. Tineo claimed that Justin’s defect was never detected by medical professionals, despite her requests to test for MTM. She sued OB-GYN Aldo Khoury; his employer, St. Joseph’s Regional Medical Center, Paterson, N.J.; the company that tested Tineo’s amniotic fluid, LabCorp of America, Burlington, N.C.; and LabCorp’s director, Dr. James Tepperberg for wrongful birth. Justin’s mother claimed that in sending out amniotic fluid to LabCorp, Khoury checked off the box on the request form for an amniocentesis test, but there was no check box for MTM testing, and although he did not write in a request, he indicated on the form that there was a family history of MTM.
Gerlad has also gained a reputation as a skilled litigator in other areas of personal injury litigation, including products liability claims and airplane crash litigation. He was a partner with the firm of Balk, Goldberger, Mandell, Seligsohn & O'Connor, in Newark, New Jersey, until 1986, when he opened offices in Chatham, New Jersey, under the name of O'Connor & Rhatican, P.C. The firm continued to practice plaintiffs' personal injury litigation with a continuing specialization in plaintiffs' medical negligence actions.
