Anthony Caggiano has practiced exclusively in civil trial law. After graduation from law school, he began working for an insurance defense law firm in Miami, Florida. In 1987, he decided to use the insight he had gained as an insurance defense lawyer to benefit victims of personal injury and medical malpractice by founding Ward & Caggiano with Dr. Walter Ward, a medical doctor and lawyer. In this interview, he discusses his work in the case of Estate of Swilley v. Desai, a major medical malpractice case involving an event where Nathan O. Swilley, 10, stepped on a nail in his yard and required medical treatment. Nathan’s mother, Christina Wallace, took him to Florida Hospital where his wound was cleaned and treated on both visits and he was sent home each time. Nathan was discharged and prescribed the IV antibiotics Gentamicin, Zosyn and Motrin. A home health care nurse was ordered to come to Nathan’s house to administer the antibiotics. The order was arranged and managed by Florida Hospital of Orlando and Children’s First Home Health Care, Orlando. Nathan’s kidneys soon began to fail, and renal failure was confirmed. Hemodialysis was also performed, as a result of which Nathan developed dialysis disequilibrium syndrome (DSS), causing brain swelling and death.

Anthony also spends a considerable amount of time offering free legal services to those less fortunate. He has been recognized by the Eleventh Judicial Circuit and the Dade County Bar Association, receiving the pro bono award for providing free legal work to those in need in the area of general civil law. On behalf of the Orange County Bar Association, he serves as a guardian ad litem for abused, abandoned, and neglected children. He is also actively involved in his community through his church and has served on the school board. In 1992, he became Board Certified in Civil Trial Law, distinguishing himself as one of less than 2% of The Florida Bar specializing in civil trial law, which includes personal injury and medical malpractice. In 1999, he was chosen to serve on The Florida Bar Civil Trial Law Certification Committee. This committee is entrusted with evaluating and testing other lawyers who wish to hold themselves out as specialists in Civil Trial Law. From 2002 through 2004, Anthony was honored to serve as Chair of this Florida Bar Committee. Anthony attended Suffolk University Law School in Boston, served as a writer and editor of its Law Journal, and graduated in 1984. He became a member of The Florida Bar in 1984 and The Massachusetts Bar in 1985.

Gary M. Zadick is a highly distinguished attorney, born and raised in Great Falls, Montana. In this interview, he talks about his groundbreaking work in the case of In the Matter of the Rules of Professional Conduct and Insurer Imposed Billing Rules and Procedures, which he filed as an original proceeding before the Supreme Court of Montana challenging the national program of “managed care” for the legal defense bar developed and used by all of the major insurers across the country. This was the first time that any attorneys in any state challenged the insurance industry program in a court. Gary joined all insurers doing business in Montana in the proceeding and asked the Supreme Court to issue a declaration concerning the national program which: 1) required defense lawyers to request permission from the insurer before doing much of anything and 2) required defense lawyers to submit their bills to outside auditors who adjusted the bills (i.e. reduced) based upon a review of the bill without reviewing the actual work product and also caused a disclosure of client confidential information that would violate the attorney-client relationship and privilege.

Gary is also an active member of his community, where he was a Deputy Cascade County Attorney from 1978-1979. He has been an associate professor of evidence and criminal procedure at the College of Great Falls. Gary attended the University of Montana and obtained a B.A. in Economics and Political Science in 1975. He then attended the University of Montana School of Law where he obtained his JD degree in 1978. He has also been a frequent lecturer at the University of Montana School of Law and other continuing legal education seminars on the issue of insurance.
